I would submit the issue is quite murky.  When the subject of the applicability of the ADA to Web content is debated, I think it is important to specify which part of the ADA is being considered (e.g., Title II vs. Title III).  There is a difference (legally, anyway) between programs, activities, and services of public entities and places of public accommodations/commercial facilities.
